JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-07-2023 The present writ petition has been filed seeking the following relief:- "1. That this writ application is being for issuance of an appropriate writ, order and directions to the Respondents concerned for quashing the notice as passed in Encroachment Case No. 04 of 2013-14 dated 30.12.2013 (Annexure-1) relating to the land which is situated in Thana No.698, Khata No.433, Kheshra No.1453, area 4 decimal issued by the learned Circle Officer, Mushahari, (Respondent no.5) whereby and whereunder the learned Circle Officer has directed the petitioner to demolish their house within notice period and
Patna High Court CWJC No.4141 of 2014(5) dt.18-07-2023 2/2 to appear on 11.02.2014 at 11 A.M. otherwise his house will be demolished by the Administration.
And further an order / direction to the respondents concerned to not demolish and harass the petitioner."
After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
