JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-12-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner apprehends her arrest in Kurtha (Manikpur) P.S. Case No. 10 of 2020 registered for the offence under Sections 366, 504, 506, 34 of the Indian Penal Code. As per the prosecution case, it is alleged that the daughter of the informant was kidnapped by the son of petitioner.
It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case due to the fact that she is mother of co-accused Shiv Shankar Kumar, who has kidnapped the daughter of the informant. Petitioner is lady aged about 58 years. There is no specific allegation against this petitioner. Considering the aforesaid facts and circumstances, the
Patna High Court CR. MISC. No.29404 of 2020(2) dt.11-12-2020 2/2 bail application of petitioner is allowed. In the event of her arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Kurtha (Manikpur) P.S. Case No. 10 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C.
