JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor of the State.

The petitioner is apprehending his arrest in connection with Sadar Hajipur P. S. Case No. 329 of 2017 registered for offences punishable under Sections 414, 406, 420/34 of the Indian Penal Code and 7 E. C. Act and 4/5 of the Prevention of Black Marketing and Maintenance of Supplies of Essential Commodities Act.

Learned counsel for the petitioner submits that the petitioner's name has come in this case on the confession of one Gulabia Devi from whose house the stolen rice was recovered and the petitioner has been named as accused in the F.I.R.

Patna High Court Cr.Misc. No.62296 of 2017 (2) dt.04-01-2018 2/2 Learned counsel for the petitioner submits that the petitioner has nothing to do with the alleged occurrence and he has clean antecedent.

Having regard to the fact that there is no specific role, regarding stealing the rice, assigned to the petitioner, I find that as far as the petitioner is concerned, at least he is entitled for grant of anticipatory bail.

Accordingly, above named petitioner is directed to be released on anticipatory bail, in the event of his arrest/surrender before the concerned Court within six weeks from today, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P. S. Case No. 329/2017, subject to the conditions enumerated under Section 438 (2) of Code of Criminal Procedure. (Mohit Kumar Shah, J) Sudha/- U T
