Mr. Sanjay Kumar A.C. to G.A. 12, for the State appears and submit that even when the petitioner who happens to be the Up-Pramukh, Panchayat Samiti, Azamnager in the district of Katihar has questioned the no confidence motion passed against him on 3.9.2013 together with the requisitions so filed in this regard but thereafter the re-election to the post taken place on 20.11.2013 has not been questioned. The

Patna High Court CWJC No.23098 of 2013 (3) dt.21-04-2016 3/3 conduct of the petitioner itself reflects that she is not interested in pursuing her remedy inasmuch as once there is a re-election to elect a new Up-Pramukh and which is not put to question then the removal of the Up-Pramukh in the no confidence motion becomes academic and taking note of such circumstances the writ petition is disposed of accordingly.
