The petitioner is languishing in custody for the offences punishable under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act in connection with Chauri P.S. Case No. 5 of 2020.

Petitioner allegedly caused fire-arm injury at the right side waist of the informant. The doctor has found consistent injury. Petitioner is in custody since 27.04.2020. The petitioner has got a list of criminal cases against him disclosed in para-3 of the bail petition. Learned counsel for the petitioner submits that the informant does not appear to be reliable as he claims that after sustaining fire-arm injury he ran and took a motorcycle for Blue Dimond Hospital, Patna, which is 10 Kilometers away. The fardbeyan of the informant was recorded at the place of his treatment.

Considering the nature of allegation and criminal antecedents of the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused. The trial Court is directed to expedite the trial. Petitioner may renew the prayer for bail after nine months if no progress takes place in trial in spite of cooperation of the petitioner.
