JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-07-2018 The petitioner is apprehending his arrest in connection with Complaint Case No. 382/2009, Tr. No.106/2017, registered for offences punishable under Section 420 of the Indian Penal Code and Section 138 of the N.I. Act.

Allegation as per F.I.R is that co-accused of this case has taken a loan of Rs. 85,000/- from the Bihar State Minorities Financial Corporation for installing Photostat Machine and the petitioner is guarantor and thereafter that money has not been returned till date.

Submission of learned counsel for the petitioner is that he is only guarantor inspite of that he has been made accused in this

Patna High Court Cr.Misc. No.44128 of 2018 (2) dt.27-07-2018 2/2 case. Moreover, the co-accused of this case has already deposited Rs.49,690/- and rest of the money of Rs.35,310/- will also be returned within a period of one month.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, this petition is disposed of with a direction to the petitioner to surrender before the Court below within a period of six weeks from the receipt of the order with a bank draft of Rs.35,310/- in favour of the Bihar State Minorities Financial Corporation and the court below after verifying the same shall release the petitioner on bail to his own satisfaction on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Vinod Kumar Sinha, J) sunil/Amjad/- U T
