2. The petitioner seeks bail in connection with Katihar Town P.S. Case No. 250 of 2024 registered for the offence punishable under Section 379 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is accused in a case of theft of motorcycle.

4. Learned counsel for the petitioner submits that the petitioner is not named in the FIR nor during entire investigation any witness has come forward to say that the petitioner was involved in the alleged crime. The name of the petitioner has transpired on the confessional statement of coaccused Md. Amir. Nothing has been recovered from the conscious possession of the petitioner.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar/ concerned Court in connection with Katihar Town P.S. Case No. 250 of 2024, subject to the condition that both the bailors should be the close relative of the petitioner.

7. The petitioner will also mark attendance in Manihari Police Station, District-Katihar on every Sunday of the month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
