Petitioner apprehends his arrest in Chautham P.S. Case No.182 of 2017 instituted for the offence under Section(s) 406, 409, 420, 467, 468, 471/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Khagaria. Prayer of the petitioner for grant of anticipatory bail was earlier rejected by this Court by order dated 23.03.2018 passed in Cr. Misc. No.9035 of 2018.
This second anticipatory bail application has been filed on the ground that co-accused, Amar Yadav, has been granted interim relief by co-ordinate Bench of this Court by order dated 02.05.2018 passed in Cr. Misc. No.10549 of 2018. This Court after looking into the earlier order dated
Patna High Court Cr.Misc. No.42641 of 2018 (2) dt.25-07-2018 2/2 23.03.2018 finds that prayer for anticipatory bail of petitioner was rejected on merit.
Therefore, this Court does not find any fresh ground to grant anticipatory bail to the petitioner. Prayer of the petitioner for grant of anticipatory bail is, again, rejected.
Petitioner may surrender and make prayer for regular bail, which will be considered by the Court below in accordance with law without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
