====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 15-01-2021 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 328/34 of the Indian Penal Code.

Petitioner is in custody since 28.11.2019. Suspicion is that the petitioner committer murder of the existing Mahanth, who was uncle of the informant, with intent to grab the seat of Mahanth. The petitioner disclosed to the informant about the occurrence that he was made unconscious by putting some injection by unknown criminals and they had taken away the deceased and committed his murder. Some witnesses stated that they had found some needle etc. at the place of occurrence and the petitioner was injured.

No.29505 of 2020(3) dt.15-01-2021 2/2 Since there is no direct material against the petitioner and he is in custody since more than a year, investigation of the case against the petitioner is already complete, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr. No. 63 of 2020 arising out of Jagdishpur Police Station Case No. 358 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.

(c) The petitioner shall not leave the country without permission of the learned trial court.
