Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks regular bail in connection with Rajapakar (Barauti OP) PS case no. 211 of 2018 instituted for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

The case of the prosecution, as per the First Information Report, is that the petitioner assaulted the informant by means of iron rod on his face.

Learned counsel for the petitioner submits that a counter case has been lodged by the petitioner's side against the informant and others bearing Rajapakar PS Case No. 212 of 2018. Learned counsel further submits that the occurrence has taken place due to trivial issue of parking of the auto-ricksaw.

No.32815 of 2024(3) dt.02-08-2024 2/2 The injury discussed in the impugned order shows that three injuries have been caused to the brother of the informant namely Gulchand Ram and one of them is stated to be on the left upper arm, which is grievous in nature. The petitioner is stated to be in custody since 10.12.2023 having no criminal antecedent. 5.
Regard being had to the submissions made by learned counsel for the parties and taking into consideration the fact that there is a case and counter case between the parties, petitioner is having no criminal antecedent and the petitioner is in custody for about 08 months, I am inclined to grant regular bail to the petitioner.

This application is, accordingly, allowed.

Let petitioner, abovenamed, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XIII, Hajipur, Vaishali in connection with Rajapakar (Barauti OP) PS case no. 211 of 2018.
