This application has been filed for review of the judgment and order dated 16.5.2013 passed in CWJC No.7624 of 2013 by a Bench presided over by Hon'ble Mr. Justice Mihir Kumar Jha (as His Lordship then was) whereby the writ petition was dismissed.

The liberty is already there in the order passed by the Bench for the petitioner to apply for voluntary retirement once he fulfils the statutory requirements provided under rule 74 (a) (iii) of the Bihar Service Code.

Admittedly the petitioner has neither completed 30 years of service nor aged 50 years when he applied for
