2. The petitioner has prayed for bail in connection with Patepur P.S. Case No. 271 of 2024 registered for the offence punishable under Section 309(4) of the Bharatiya Nyaya Sanhita, 2023.
3. The case of the prosecution is that the informant is working as a Manager in M/s Gos Logistic Company, Muzaffarpur and his company vehicle bearing registration no. UP78GT-5037 left from Delhi for Assam on 10.09.2024 carrying Shikhar Pan Masala, 150 bags of Cigarette were loaded on this vehicle. This vehicle was overtook by DCM truck and 34 unknown persons took the vehicle near newly constructed godown of one Dinesh Thakur and all the goods were unloaded

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It has also been submitted that the F.I.R. was lodged against unknown miscreants. His name has surfaced only on the basis of his confessional statement. It has further been submitted that nothing has been recovered from his possession. No T.I.P. has been conducted. Co-accused having similar nature of allegation has been granted bail by learned Coordinate Bench vide Criminal Misc No. 28547 of 2025. The case of this petitioner stands on similar footing. Petitioner is languishing in judicial custody since 24.12.2024.
5. The application for bail is opposed by learned APP for the State and he submits that the petitioner has got two criminal antecedent.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM,
