Learned counsel for the petitioner submits that the petitioner was not arrested from the spot as such nothing was recovered from his conscious possession and he came to be implicated based on confessional statement of Tetri Devi in police custody which does not have any evidentiary value. It is further submitted that Tetri Devi is mother of the petitioner and she was made to confess the name of the petitioner under duress, when petitioner admittedly is a person with clean antecedent.
