JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-12-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Teghra P.S. Case No. 237 of 2019 registered for the offence under Sections 341, 323, 307/34 of the Indian Penal Code.

As per the prosecution case, on 14-06-2019 at about 8:30 AM, it is alleged that all the accused persons including this petitioner were cutting bamboo of informant, which was objected by the informant upon which accused persons assaulted him. Petitioner is alleged to have caused injury on his chest and left arm by lathis.

It is submitted on behalf of petitioner that thrust of accusation is against co-accused Anil Singh and Sunil Singh. So far as this petitioner is concerned, he has caused injury on

Patna High Court CR. MISC. No.29227 of 2020(2) dt.05-12-2020 2/2 informant's left arm and chest, and as per injury report (Annexure - 2), same has been found to be simple in nature. Both sides are gotiyas and old land dispute is going on between them. It is stated in paragraph - 3 of the petition that petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances, the bail application of petitioner is allowed. In the event of his arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Teghra P.S. Case No. 237 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
