2. The petitioner apprehends his arrest in a case registered for the offence under Section 366A/34 of the Indian Penal Code.
3. The allegation against this petitioner is that he alongwith other co-accused persons kidnapped the minor daughter of informant.
4. Learned counsel for the petitioner submits that as per F.I.R., specific allegation of kidnapping is against coaccused Suman Kumar Pal. So far as this petitioner is concerned, he has been made accused merely because he happens to be brother of co-accused Suman Kumar Pal. The
Patna High Court CR. MISC. No.32768 of 2024(4) dt.05-08-2024 2/2 victim, in her statement recorded under Section 164 Cr.P.C., has specifically stated that she voluntarily went with co-accused Suman Kumar Pal. The victim has not stated anything wrong against this petitioner. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VI cum Exclusive Special Judge, POCSO Act, Aurangabad (Bihar) in connection with Amba P.S. Case No. 229 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
