Kamaluddin, learned counsel appearing on behalf of the petitioner and Mr. Amarendra Nath Verma (Sr. Panel Counsel) along with Mr. Rakesh Kumar Sinha, learned counsels for the Union of India.

Mr. Amarendra Nath Verma, learned Sr. Panel Counsel for the Union of India submits that he will defend the order passed by the Competent Authority by bringing on record the assessment made in respect of the income of family on the date, the claim of the petitioner was being considered in spite of the fact that 5% of the total post was earmarked for compassionate appointment.
3. This Court finds that instead of keep pending the
Patna High Court CWJC No.345 of 2012(7) dt.02-07-2024 2/2 present writ petition, which was filed in the year, 2012, I find it proper to direct the appropriate authority to consider the claim of the petitioner, who has made application for considering him to be appointed on compassionate ground, in the light of the principle of law laid down by the Apex Court in case of Umesh Kumar Nagpal v. State of Haryana and Others reported in (1994) 4 SCC 138.
4. Accordingly, the present writ petition stands disposed of.
