The petitioners are apprehending arrest in a case registered for the offences punishable under sections 302/34 of the IPC. The prosecution case is that the daughter of the informant Rubi Devi was married with co-accused Santosh Kumar in 2006. They were blessed with three children. On 2.7.2017 the informant received a telephonic information that his daughter has been killed. When he reached the inlaw's village of his daughter, he came to know that the husband of his daughter Santosh is having illicit relationship with his niece Rekha Devi, which was protested by the victim, as a result, all the accused persons killed her.
It is submitted by learned counsel for the petitioners that the thrust of accusation is against the husband of the victim,
Patna High Court Cr.Misc. No.1585 of 2018(2) dt.11-01-2018 2/2 namely Santosh Kumar. The accusation against the petitioners is omnibus and general. It is further submitted that the petitioners are mother and step mother of the husband of the victim and are having no criminal antecedent.
Learned APP submitted that there are accusations against the petitioners.
Considering the fact that accusation against the petitioners is omnibus and general, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 203 of 2017 subject to the conditions as laid down in Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) anil/- U
