2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 309(6) of BNS.

3. The case of the prosecution is that unknown miscreants have taken away Rs. 35,000/- from the informant and have assaulted him with the butt of the pistol.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the FIR was lodged against unknown miscreants. During course of investigation, one co-accused Sudhir has given his confessional statement and he has named this petitioner in his confessional statement. Save

Patna High Court CR. MISC. No.29899 of 2026(2) dt.07-05-2026 2/2 and except confessional statement, there is nothing against him. Nothing has been recovered from the possession of the petitioner. No TIP was conducted during course of investigation. Moreover, the petitioner is languishing in judicial custody since 24.02.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jadia P.S. Case No. 83 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul.
