JUSTICE RAMESH KUMAR DATTA ORAL ORDER 18-10-2016 It is submitted by the learned counsel for the State that against the order under contempt, L.P.A. No. 1613 of 2013 has been filed which is still pending. It is further submitted that subsequent to the decision of this Court, the Full Bench of this Court has decided to the contrary by order dated 07.08.2014 passed in C.W.J.C. No. 1484 of 2006.

In the aforesaid circumstance, the contempt application is dismissed with liberty to the petitioner to approach this Court again in case the appeal against the order under contempt is decided in favour of the petitioner. It is stated by the learned counsel for the State that

Patna High Court MJC No.5203 of 2013 (5) dt.18-10-2016 twice the amount had been tendered to the petitioner by cheque, firstly, before passing of the order under contempt and the second time recently on 27.09.2016, but the petitioner has not come forward to receive the same.

Let the amount as calculated by the State be received by the petitioner within a period of six weeks from today along with which the opposite parties shall also give a calculation chart to the petitioner.
