JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-01-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners seek pre-arrest bail in connection with Kalyanpur P. S. Case No. 138 of 2017 registered under Sections 147, 148, 149, 448, 323, 307, 379 and 504 of the Indian Penal Code.
Regard being had to the specific allegation made against the petitioners that they being variously armed with garasi and dab assaulted the brother and niece of the informant as a result of which they sustained injuries on their person, I am not inclined to grant them pre-arrest bail. Accordingly, the
Patna High Court Cr.Misc. No.1256 of 2018 (2) dt.19-01-2018 2/2 application for grant of pre-arrest bail is rejected. However, in case the petitioners surrender and seek bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
