In this case, claim has been made by the petitioner to grant the benefit of 1st, 2nd and 3rd Assured Career Promotion(ACP). It appears that the petitioner has already been given the 1st and 2nd ACPs. and he has not been given the 3rd ACP, but from the letter dated 23.03.2013 reflects, the petitioner has been denied the 3rd ACP on account of his suspension at Block-Sandesh and the District Magistrate had not decided the issue with respect to the period of his suspension, on that account, the issue of granting 3rd ACP is under

Patna High Court CWJC No.11890 of 2013 dt.08-09-2016 2/2 consideration.

Let the District Magistrate, Bhojpur decide the case of the petitioner with respect to the period of his suspension at BlockSandesh and after the decision by the District Magistrate, the case with respect to granting of 3rd ACP will also be considered by the respondent in terms of Rule and if it is found that the petitioner is entitled to 3rd ACP, consequential benefit must be given to him. All the process must be completed within a period of six months from the date of receipt/production of a copy of this order. Accordingly, this petition is disposed of.
