The petitioners seek pre-arrest bail in connection with Kalyanpur P.S. Case No.138 of 2017 registered under Sections 147, 148, 149, 448, 323, 307, 379 and 504 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioners that there is case and counter case and three persons from the side of the petitioners also sustained injuries.
No body appears on behalf of the State to oppose the application for grant of pre-arrest bail to the petitioner. Regard being had to the direct and specific allegation
Patna High Court Cr.Misc. No.939 of 2018 (2) dt.16-01-2018 2/2 against the petitioners that they assaulted causing serious injuries to three persons, I am not inclined to grant them pre-arrest bail. Accordingly, the application for grant of pre-arrest bail is rejected.
In case the petitioners surrender and seek bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
