JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-03-2021 Heard Mr. Krishna Chandra, learned counsel for the petitioners and Mr. Lalit Kishore, learned Advocate General for the State and the Bihar School Examination Board.

Pursuant to the order dated 10.12.2020, the learned Advocate General had looked into the matter and today, he has submitted before the Court that a special examination shall be held for all the 106 candidates who were prevented from appearing in the examination on the ostensible plea of their having been made accused in a criminal case with respect to vandalism at one of the examination centres in Gaya.

The natural corollary of this decision of the respondents is that relevant numbers of seats would be kept vacant for making the entire exercise fruitful.

Patna High Court CWJC No.7793 of 2020(6) dt.02-03-2021 3/3 With this decision of the respondents of conducting the examination separately for those 106 candidates within a period of three months, this Court does not want to continue the proceedings of this case and drops it instantaneously. The petition is disposed of in view of the disclosure made by the learned Advocate General.

This Court records its appreciation for the balanced and rational approach of the learned Advocate General in this matter.
