JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 04-04-2018 The petitioner has renewed his prayer for pre-arrest bail in connection with Magadh Medical P.S. Case No.26 of 2017 registered for the offence Punishable under Section 30(a)(d) of the Bihar Prohibition and Excise Act, 2016. His earlier application for grant of pre-arrest bail was rejected by this Court vide order dated 13.07.2017 passed in Cr.Misc. No.30096 of 2017 on the ground that in view of the statutory provision prescribed under Sub Section (2) of Section 76 of the Bihar Prohibition and Excise Act, 2016, an application for grant of pre-arrest bail is not maintainable.

No fresh ground has been made out in the present case

Patna High Court Cr.Misc. No.2361 of 2018 (2) dt.04-04-2018 2/2 for renewal of pre-arrest bail.

Accordingly, the application is dismissed as not maintainable.
