2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 302 and 34 of the I. P . C .
3. As per the prosecution case , on the alleged date and time of occurrence, all the F.I.R., named accused persons including this petitioner assaulted the father and son of the informant, as a result of which father of the informant died.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to village politics. There is no specific allegation of assault against the petitioner. None of the witness has supported the prosecution case. There is no other material available on
Patna High Court CR. MISC. No.34495 of 2024(3) dt.27-06-2024 2/2 record to show his complicity of the petitioner in the present case . Petitioner claims clean antecedent.
5. Learned counsel for the State as well as informant opposed the prayer for bail and submitted that petitioner is named in the F.I.R., and there is specific allegation against him is that he along with other co-accused persons assaulted the father of the informant (deceased), as a result of which the deceased sustained seven head injuries and died.
6. Considering the nature of accusation and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
