JUSTICE ANIL KUMAR SINHA ORAL ORDER 18-12-2020 Heard Mr. Ramchandra Singh, learned counsel for the petitioner and Mr. Vinod Shankar Modi, Additional Public Prosecutor for the state through video conferencing.

2. Petitioner apprehends his arrest in connection with Brahmpur (Krishna Brahm) PS Case No. 65/2020 registered for the offence punishable under Sections 420, 467, 468, 471, 120B of the Indian Penal Code.

3. The allegation, as per First Information Report, is that petitioner at the time of his appointment for the post of Block Teacher submitted forged and fabricated educational certificates.

4. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and before holding his certificates to be forged and fabricated, no inquiry was conducted by the authorities and the petitioner was also not noticed in this regard. Learned counsel further submits that similarly situated accused person, namely, Jai Ram Singh,

Patna High Court CR. MISC. No.29544 of 2020(2) dt.18-12-2020 2/2 whose certificate was also found forged and fabricated, has been granted anticipatory bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 27243/2020.

5. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that similarly situated accused person has been granted anticipatory bail by a Co-ordinate Bench of this Court, I am inclined to grant anticipatory bail to the petitioner.

6. Accordingly, petitioner, RAMESH YADAV shall be released on anticipatory bail, in the event of arrest or surrender within six weeks, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Brahmpur (Krishna Brahm) PS Case No. 65/2020, subject to the conditions as laid down under Section 438(2) CrPC.

7. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
