In this case, the petitioner is seeking anticipatory bail in connection with Naubatpur, P.S. Case No. 621 of 2018 registered for offence punishable under section 7 of the Essential Commodities Act.
It has been alleged that 25 quintal wheat has been recovered from the ancestral house of the petitioner. The learned counsel for the petitioner submits that earlier it was a poultry farm and now it became dairy farm and for earning, the petitioner used to work at Delhi and in support of his submission, he has attached Adhar card and a memorandum certificate issued by the General Manager of Sandeep Publicity, New Delhi where the petitioner is working, although he used to stay
Patna High Court CR. MISC. No.31787 of 2019(2) dt.14-05-2019 2/2 in New Delhi and the petitioner has no house at his native village rather there is an ancestral family house in his village Anantpur where the petitioner does not reside rather he resides in Delhi for livelihood. Further submission is that the petitioner has wrongly been implicated in the present case.
Looking to the facts and circumstances of the case, the prayer for bail of the petitioner is allowed and he, in the event of arrest or surrender before the court below within six weeks from today, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Danapur in connection with Naubatpur, P.S. Case No. 621 of 2018, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
