The petitioner is languishing in custody for the offences punishable under Section 304B of the Indian Penal Code and Section 3⁄4 of the D.P. Act in connection with Paharpur P.S. Case No. 130 of 2019.

Wife of this petitioner died in unnatural circumstances within a month of her marriage. Allegation is that dowry death was committed for non-fulfillment of demand of motorcycle and a gold chain. Other witnesses have also supported the allegation of demand of dowry and torture for the same. Petitioner is in custody since 18.12.2019.

Considering the nature of allegation and presumption of law against the petitioner, I am not inclined to enlarge the

Patna High Court CR. MISC. No.29647 of 2020(3) dt.18-01-2021 2/2 petitioner on bail. Hence, the prayer for bail is refused. The learned trial Court is directed to expedite the trial and conclude the same within nine months, failing which the petitioner would be at liberty to renew the prayer for bail before the trial judge itself.
