The petitioner seeks bail in connection with Hisua P.S. Case No. 33 of 2023 registered for the offence punishable under Sections 341, 323, 307, 354(B), 379, 504 and 34 of the Indian Penal Code.
As per prosecution case, the allegation against the petitioner is that he assaulted the informant with iron rod and caused injury to her.
Learned counsel for the petitioner submits that petitioner and informant both are co-villagers and there is some dispute between them. The petitioner has falsely been implicated in this case. Petitioner has no concerned with the alleged occurrence. The injury report shows that the informant
Patna High Court CR. MISC. No.30635 of 2023(2) dt.14-06-2023 2/2 sustained injury of pain, swelling and abrasion. Petitioner has no criminal antecedent and is in jail custody since 25.01.2023. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Nawada in connection with Hisua P.S. Case No. 33 of 2023.
