JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 19-06-2018 From the show-causes and the materials that have come on record, it is clear that as far as petitioner Dr. Arun Kumar Jha is concerned, the departmental authorities have already issued Authority Slip for payment of arrears of pension,
Patna High Court MJC No.1674 of 2012(20) dt.19-06-2018 2/3 gratuity and other monetary benefits to the petitioner and the Authority-Slips have been forwarded to the Treasury Officer, Samastipur for necessary payment.
The Treasury Officer, Samastipur is directed to ensure that in accordance to the Authority Slip, all arrears of pension, gratuity and other payments authorized are paid to the petitioner within a period of one week from the date of receipt of certified copy of this order, if not already done and thereafter a report submitted to the Registrar General of this Court by the Treasury Officer, Samastipur. In case the Treasury Officer, Samastipur does not submit the report to the Registrar General of this Court on or before 16th of July, 2018, the Registrar General is directed to bring this fact to the notice of this Court and this Court would consider taking coercive action against the Treasury Officer for the default committed in making payment of the Authority Slip issued in favour of the petitioner.
Patna High Court MJC No.1674 of 2012(20) dt.19-06-2018 3/3 which this Court would consider taking coercive action against the authorities of the Provident Fund Department. As far as the petitioner Upendra Kumar is concerned, it is an admitted position that all his claims have been settled. However, if there is any issue between the petitioner and the department with regard to issuance of tax deducted or other issue, he may take it up with the concerned authority of the department.
