The writ petition involves the issue of appointment of
Patna High Court CWJC No.6574 of 2012(4) dt.22-06-2018 2/2 Panchayat Teacher pursuant to selection process commenced in the years 2008. Ten years have elapsed and at this stage when the dispute is that the petitioner has not appeared in the counselling. Petitioner is not present in the present proceeding. In addition thereto, when there is statutory remedy by way of appeal before the State Appellate Authority, the court does not find any justification to keep this matter pending any further.
In view of the facts and circumstances indicated hereinabove, the writ petition is disposed of with liberty to the petitioner if he is still interested with the present case, he may approach the State Appellate Authority by filing appeal within a period of two months from today alongwith the copy of this order and in case, such appeal is filed by the petitioner before the State Appellate Authority, the State Appellate Authority will decide the appeal on its own merit after condoning the delay in filing the appeal considering the fact that the writ petition involving the issue remain pending since 2012. With the aforesaid, the writ petition stands disposed of.
