2. The present petition has been filed on behalf of the petitioners, apprehending their arrest, in connection with Bochahan P.S. Case No. 314 of 2019, registered for the offences punishable under Sections 406, 420, 467, 468, 471 and 120B of the Indian Penal Code.
3. The complaint case was filed before CJM, Muzaffarpur and under Section 156(3) of the Cr.P.C. present FIR has been registered. The prosecution case is that all the accused persons including the petitioners in collusion with each other took cash of Rs. 34,80,000/- from the complainant /
Patna High Court CR. MISC. No.34561 of 2023(2) dt.21-07-2023 2/3 informant as consideration money and got executed a sale deed by forging documents.
4. The learned counsel for the petitioners has submitted that petitioners have falsely been implicated in the present case and the sale deed was actually executed by the brother of the petitioner No. 1, namely, Anjani Kumar Shahi by impersonating him for which the petitioners have also lodged cases against him and others. The allegation made against the petitioners is civil in nature and the petitioners have also filed Title Suit No. 601 of 2019 against the informant and others. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
5. The learned APP for the State opposes the prayer for bail.
6. Considering the aforesaid facts and circumstances, the petitioners above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - 14th , Muzaffarpur, in connection with Bochahan P.S.
