Petitioner seeks anticipatory bail in Palasi P.S. Case No.218 of 2016 instituted for the offence under Sections 493. 120(B) of the I.P.C. and Section 8 of the POCSO Act Informant is the father of the girl who filed complaint petition before the C.J.M., Araria giving rise to Palasi P.S.Case No.218 of 2016, alleging therein that on 5.4.2016 when he was not in his house and her daughter, Puja Kumari, was alone the petitioner enticed her away for solemnizing marriage with her and thereafter established physical relationship with her and subsequently denied to marry with her. The complaint petition was filed on 26.04.2026 after about twenty days of the alleged

It has been submitted by the counsel for the petitioner that the victim was medically examined and as per the medical report she is above 18 years. It has been further submitted that the petitioner and the daughter of the informant Puja Kumari had thereafter compromised the matter and both have stated that they have solemnized marriage but on account of some confusion for which complaint case was filed and now they are living together as wife and husband.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Araria, in Palasi P.S.Case No.218 of 2016 subject to the condition as laid down under Section 438(2) of Cr.P.C.
