2. This writ application has been filed for the following reliefs:

(i) To hold and declare that, in view of the various orders passed by this Hon'ble Court and Hon'ble Apex Court, as well as Letter No. 432 dated 20.04.2020, issued under the signature of the Director (Primary Education), Education Department, Govt. of Bihar, (Annexure-5), so far it relates to the Assistant Teachers Appointed prior to 31.12.1995, the matter of grant of "Financial Progression", has had attained the finality.

(ii) For issuance of appropriate orders,

Patna High Court CWJC No.7974 of 2024(2) dt.26-11-2024 2/3 direction or writ in the nature of Mandamus for directing the respondents concerned to extend benefit 2nd Financial Progression (now MACP) with effect from 02.09.2014, upon completion of 20 years of service, calculating the length of service from the date of appointment.

3. Learned counsel for the petitioner submits that petitioner has filed several representations for redressal of his grievance but no action has been taken till date. Petitioner seeks disposal of the writ application granting him liberty to file fresh representation before the District Education Officer, DistrictPatna (Respondent No. 3).

4. In view of the aforesaid submission, petitioner is directed to file fresh representation before the District Education Officer, District- Patna (Respondent No. 3) with all the supporting documents and notifications within a period of four weeks from today.

5. If such, representation is filed by the petitioner within the stipulated time period, Respondent No. 3 shall dispose of the same, after hearing the parties, by a speaking and reasoned order, in accordance with law, within a period of three months from the date of filing of such representation.
