The petitioners apprehend their arrest in Ramnagar P.S. Case No.362 of 2017 registered under Sections 427, 379 and other Sections of the Indian Penal Code.
The informant alleged that the petitioners and others assaulted the members of the Hindu community who were selling vegetables on thela.
The learned counsel for the petitioners submits that three cases being Ramnagar P.S. Case No.362 of 2017, 363 of 2017 and 364 of 2017 were registered for the same occurrence. The petitioners are of course made accused in the F.I.R. but no
Patna High Court Cr.Misc. No.63717 of 2017 (2) dt.12-01-2018 specific allegation is made against the petitioners. In Ramnagar P.S. Case No.363 of 2017, the named accused persons have already been granted anticipatory bail. From the side of the petitioners also, counter case is lodged.
Considering the facts aforesaid and the fact that no specific allegation is made against the petitioners and there is minor scuffle between the members of two community, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bagaha, West Champaran in connection with Ramnagar P.S. Case No.362 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
