JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-12-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under sections 25(1-B)a, 26 and 35 of the Arms Act and 4,5,6 of the Explosive substance act. Learned counsel appearing for the petitioner submits that as per the FIR there is no recovery from the possession of the petitioner and the recovery of arms and explosives is from the possession of other accused persons. Petitioner claims clean antecedent. Petitioner is in custody since 14.1.2021. Investigation is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the rival submissions of the parties, materials available on the record and the period of custody of

No.39500 of 2021(2) dt.14-12-2021 2/2 the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate Purnea in Baisi Police Station Case No. 18 of 2021.
