2. Petitioner retired as Assistant Manager from Regional Office, Bangalore, Karnataka on 28.02.2017. In the present writ application, he prays for payment of gratuity and leave encashment with admissible interest.

3. A similar matter has been decided by this Court on 06.05.2019 in CWJC No. 1238 of 2018 (Ganesh Dutt Mishra Vs. The National Cooperative Consumers Federation of India Ltd. & Ors.) wherein it has been observed that in similar matter High Court of Calcutta in WP No. 194 of 2014 in the case of

Patna High Court CWJC No.15382 of 2018(2) dt.15-05-2019 2/2 Kumaresh Das Vs. National Cooperative Consumers' Federation of India Ltd. & Ors. had directed the authorities to release the legitimate dues to the employee with interest @ 8% payable after the date of retirement of the said employee.

Consider the aforesaid, this writ application is disposed of with direction to Respondent No. 2, the Managing Director, National Cooperative Consumer Federation India Ltd., Government of India to consider the claim of the petitioner and make payment of leave encashment and gratuity along with interest @ 8% from the date of retirement of the petitioner i.e. 28.02.2017 within a period of three months from the date of receipt/ production of a copy of this order.
