05-01-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Complaint Case No. 1771 of 2017 for the offence under Sections 420, 468, 471, 323, 504 of the Indian Penal Code.

As per the complaint petition, the allegation against petitioner is that he fraudulently sold the land of mosque to others for a consideration amount of Rs. 46,500/- and when complainant protested, it is alleged that petitioner also assaulted him.

It is submitted on behalf of petitioner that dispute is purely of civil nature. The petitioner was authorized to look

Patna High Court CR. MISC. No.29073 of 2020(3) dt.05-01-2021 2/2 after the said mosque by the Circle Officer in Mutation Case No. 9/2014-15. It is stated in paragraph - 3 of the petition that petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances, the bail application of petitioner is allowed. In the event of his arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate - VIth, Araria in connection with Complaint Case No. 1771C of 2017, subject to condition as laid down under Section 438(2) of the Cr.P.C.
