The petitioners have prayed for regular bail in a case registered for the offence punishable under Sections 147, 341, 323, 324, 325, 307, 504 and 506 of the Indian Penal Code.

According to F.I.R, the prosecution case, in brief, is that while the informant was sitting at his door step, all these petitioners having lathi, farsa, talwar and other similar

No.33249 of 2023(2) dt.24-06-2023 2/3 deadly weapons attacked on his door step and assaulted him as a result of which he sustained injuries in his hand and head and he fell down. Some accused persons entered into the house of the informant and took away the ornament worth Rs. 1,50,000/-and cash of Rs. 50,000/- Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. The petitioners have falsely been implicated in this case due to village politics. There is a case and counter case between the parties. As per injury report at Annexure-4, the informant received one injury on his head which is simple in nature and another grievous injury in his lower forearm which is not vital part of the body. The petitioners have got no criminal antecedent. It is further submitted that the petitioners are languishing in judicial custody since 29.03.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody of the petitioners, this court is inclined

Patna High Court CR. MISC. No.33249 of 2023(2) dt.24-06-2023 3/3 to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Piprahi P.S. Case No. 45 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st, Sheohar.
