The petitioner seeks bail in connection with Mokama P.S. Case No. 105 of 2015 for the offence under Sections 147, 148, 149, 324, 307, 302 and 120B of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that earlier the prayer for bail of this petitioner had been rejected by this Court vide order dated 28.01.2020 passed in Cr. Misc. No. 74393 of 2019. Now the prayer for bail of this petitioner has been renewed on the ground of custody as the petitioner is languishing in judicial custody since 18.07.2019 i.e. more than one and half year and the
Patna High Court CR. MISC. No.30691 of 2020(2) dt.22-12-2020 2/2 likelihood of conclusion of trial is not expected in near future. Therefore, petitioner may be enlarged on bail. Learned A.P.P. for the State has opposed the prayer for bail and submitted that the petitioner is having criminal antecedent other than this case.
Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh (District Patna) in connection with Mokama P.S.
