ABHISHEK REDDY ORAL ORDER 30-09-2024 The present writ petition is disposed of at the stage of Admission with the consent of both the parties. Having regard to the fact that the petitioner is having an alternative and effective remedy of filing an application under Section 42 (5) of the Electricity Act, 2003 before the Consumer Grievance Redressal Forum (C.G.R.F.).
2. The present writ petition is disposed of granting liberty to the petitioner to approach the C.G.R.F. within a period of six weeks from the date of receipt of the copy of this order. On such application being filed, the same shall be entertained by
Patna High Court CWJC No.6968 of 2024(4) dt.30-09-2024 2/2 the C.G.R.F. and necessary orders passed strictly in accordance with law. The entire exercise shall be completed as expeditiously as possible preferably within a period of eight weeks from the date of filing of the application by the petitioner. It is needless to observe that before passing any order, the petitioner shall be given an opportunity of hearing. Any order passed shall be communicated to the party. Till such time the final orders are passed to the application filed by the petitioner, the electricity connection restored by the department pursuant to the interim order of this order on 07.05.2024 shall continue, however, it is made clear that the petitioner shall pay the current monthly charges levied by the department within the stipulated time.
