Petitioner apprehends his arrest in connection with Narpatganj (Basmatiya) P.S.Case No. 292 of 2018 registered for the offences punishable under Section 414 of the Indian Penal Code.

Allegation against the petitioner is of recovery of motorcycle on raid.

Submission of learned counsel for the petitioner is that the whole story appears to be absurd as in presence of six police personnel the petitioner fled away and nothing has been recovered from his possession, rather motorcycle was recovered from near the Durga Mandir.

No.45353 of 2018 (2) dt.02-08-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit.
