2. The petitioner has preferred this application for grant of regular bail in connection with Baldaur P.S. Case No. 317 of 2025 dated 07.11.2025 registered for the offences punishable under Sections 80 and 3(5) of B.N.S.

3. The prosecution case, in brief, is that the informant's sister was married to co-accused Praveen Sah according to Hindu rites and rituals and that gifts, jewellery and cash were given at the time of marriage. After about two years of cordial marital life, the petitioners, along with other accused persons, began demanding rupees one lakh as dowry and subjected the deceased to cruelty and assault on account of

It is further alleged that despite attempts of settlement by the informant and his family members, the harassment continued, and on 06.11.2025, when the deceased was about eight months pregnant, the accused persons allegedly killed her by hanging.

4. Learned counsel for the petitioner has submitted that petitioner is the elder brother-in-law of the deceased and there is general and omnibus allegation against the petitioner. It has further been submitted that the husband of the deceased is already in judicial custody. It has further been submitted that petitioner used to reside separately from the deceased and her husband, and had no involvement in their day to day affairs. It has further been submitted that during the post-mortem examination, autopsy surgeon has not found any external or internal injury upon the person of the deceased and the opinion regarding cause of death has been reserved, awaiting F.S.L. report. It has further been submitted that five other co-accused persons, has been granted the privilege of anticipatory bail by a Co-ordinate Bench of this Court by order dated 11.05.2026 passed in Cr. Misc. No. 87945 of 2025 and Cr. Misc. No. 16995 of 2026. It has further been submitted that charge-sheet has been filed in this case and there is no allegation of tampering against

It has further been submitted that petitioner has been named as an accused in one another case and he is currently on bail in that case. It has lastly been submitted that petitioner has been in custody since 17.12.2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

6. Heard learned counsel for the parties and perused the records.

7. Considering the entire facts and circumstances of the case as well as parity, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Khagaria in connection with Baldaur P.S. Case No. 317 of 2025.

8. The application stands allowed.
