2. The petitioner has prayed for bail in connection with Jhajha P.S. Case No. 526 of 2024 registered for the offence punishable under Sections 333, 126(2), 115(2), 109, 117(2), 74, 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The case of the prosecution is that on 17.11.2024 while the informant was sleeping with her daughter, Neetu Kumari, it is alleged that certain miscreants entered in our house and assaulted with the butt of gun due to which the daughter of the informant received many injuries and her 6 teeth were broken. Patna High Court CR. MISC. No.30698 of 2025(2) dt.20-05-2025 2/3 stated that co-villager Umesh Yadav and Manoj Yadav were seen wandering near her house. She has also stated that she can identify the assailants.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It has also been submitted that his name has surfaced in this case on the basis of his antecedent and suspicion. He has also submitted that the informant claims to identify the miscreants, but in this case till today, T.I.P. has not been conducted. Though the petitioner is having criminal antecedent of 14 cases, but from perusal of the F.I.R., it is clear that there is no direct allegation against him. Petitioner is languishing in judicial custody since 23.01.2025.
5. The application for bail is opposed by learned APP for the State and he has submitted that the main allegation is against this petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties
