JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-08-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Town P.S.Case No. 264 of 2013, registered for offences punishable under Section 414 of the Indian Penal Code and also under Section 27 of the Arms Act.

Allegation against the petitioner is that the petitioner along with three other accused persons was intercepted alongwith the stolen motorcycle.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case only due to misunderstanding on the part of the informant and police never knocked the door of the petitioner and after lapse of four years the petitioner has been apprehended.

Patna High Court Cr.Misc. No.50432 of 2018 (2) dt.31-08-2018 2/2 Learned A.P.P. opposes the prayer for bail.

In view of the facts and circumstances discussed above, let the petitioner, above named, has been accused in three other cases in which two of the cases in which the petitioner has been released on bail and under the circumstance, I am not inclined to grant bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrenders before the Court below and makes prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court.

With the aforesaid observation, this application is dismissed.
