Petitioners apprehend their arrest in connection with Kargahar P.S.Case No. 35 of 2018 registered for the offences punishable under Sections 363, 366A and 34 of the Indian Penal Code.

Allegation against the petitioners is of kidnapping and committing rape upon the minor daughter of informant. Submission of learned counsel for the petitioners is that there is contradiction in the statement of the girl recorded under Section 164 Cr.P.C. and her earlier statement. Heard learned APP and learned counsel for the informant.

Having heard both sides and in view of allegation, I am

Patna High Court Cr.Misc. No.41866 of 2018 (2) dt.19-07-2018 2/2 not inclined to grant privilege of anticipatory bail to the petitioners.

Accordingly, this application is dismissed.
