JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-09-2019 This is an application for grant of anticipatory bail in connection with Kishanganj Mahuila P.S. Case No. 2 of 2019, disclosing offences under Sections 498A, 34 of the Indian Penal Code and Section 3⁄4 of D.P. Act.

Case is under Section 498-A of the IPC.

On appearance of the opposite party no. 2, the matter was referred to the District Mediation & Reconciliation Center, Katihar, vide order dated 16.07.2019. The report of Mediator is available on record at Flag "M" which disclosed that before the Mediator both the parties have filed a joint application that they will live separately and they will file a divorce petition by way of mutual consent.

Patna High Court CR. MISC. No.29010 of 2019(7) dt.04-09-2019 2/2 Learned counsel for the petitioner and learned counsel for the opposite party no.2 have admitted the above facts. Having heard both sides, considering the above facts and circumstances, as stated above, the provisional bail granted to the petitioner vide order dated 02.05.2019 is confirmed. With the above, this application is allowed.
