2. The petitioner apprehends arrest in connection with Majhauliya PS Case No.507 of 2025 dated 01.08.2025, instituted under Sections 190, 191(2), 191(3), 126(2), 115(2), 303(2), 74, 109(1), 324(2), 308(4) of the Bharatiya Nyaya Sanhita, 2023.

It is alleged that on the date of occurrence when the informant was going towards her parental house from her matrimonial house with her son on motorcycle, the petitioner and other accused persons stopped her and then assaulted her and her son by means of iron rod, sword etc. Specific allegation against the petitioner is that he assaulted the son of the
Patna High Court CR. MISC. No.31865 of 2026(2) dt.07-05-2026 2/3 informant with iron rod. Other accused persons also assaulted the informant, her son as well as other injured persons.

Learned counsel for the petitioner submits that there is specific allegation against Saddam that he assaulted the son of the informant by means of sword due to which he received head injury while allegation against the petitioner is that he assaulted the son of the informant by means of iron rod. It is further submitted that there is case and counter case between the parties and the counter case has been filed by Nurnesha Khatoon against the informant and others. Learned counsel further submits that co-accused, Sheikh Anwar @ Anwar Hussain, Shahnawaz Alam, Aashik Alam and Saddam Hussain have been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 25.03.2026 passed in Cr. Misc. No.12685 of 2026. Lastly, it is submitted that two criminal cases are pending against the petitioner.
5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two

No.31865 of 2026(2) dt.07-05-2026 3/3 sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran, in Majhauliya PS Case No.507 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
7. The application stands allowed.
