====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with Excise Case No. 159 of 2020 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.
As per the prosecution case, 7.200 litres of foreign liquor has been recovered from the house of the petitioner. It is submitted on behalf of the petitioner that recovery has not been made from possession of the petitioner and he has been falsely implicated in this case. It is further submitted that the petitioner is having no criminal antecedent as stated in paragraph No. 3 of the petition.
Patna High Court CR. MISC. No.29055 of 2020(2) dt.02-12-2020 2/2 Considering the aforesaid facts and circumstances and the fact that the recovery has been made from the house of the petitioner, I am not inclined to grant anticipatory bail to this petitioner. It is, accordingly, rejected.
