JUSTICE ANIL KUMAR SINHA ORAL ORDER 27-03-2023 Learned counsel for the petitioner submits that in paragraphs- 10 & 11 of the counter affidavit filed on behalf of the respondent no. 5 it is stated that the petitioner has been granted selection grade pay scale of Rs. 9300-34800/-, grade pay of Rs. 4800/- with effect from 31.03.2007 and 01.04.2007 respectively and the grievance of the petitioner has been redressed. But the actual benefit arising out of the selection grade pay scale has not been paid.

In view of the fact that selection grade pay scale has already been granted, this writ application is disposed with liberty to the petitioner to file representation before respondent

Patna High Court CWJC No.12698 of 2015(3) dt.27-03-2023 2/2 no. 5 / District Education Officer, Madhubani for payment of actual monetary benefit pursuant to grant of selection grade pay scale if the actual benefit has not yet been paid. It is made clear that if representation is filed by the petitioner, the concerned authority shall dispose the same in accordance with law within a period of one month from the date of filing of the representation and if any amount is found payable to the petitioner towards the arrears, the same shall paid within a period of further one month from the date of disposal of the representation of the petitioner.
